The Scales of Justice: The Shakespearean Juridical Lessons in Measure for Measure

Abstract

This article analyzes Measure for Measure by William Shakespeare. It proposes that Shakespeare presents us with a hard case. The play allows us to study three possible conceptions of law and justice and the practical effects of choosing one over the other on individuals. Shakespeare illustrates these three alternatives through Angelo, the “angel”, the theatrical solution of the Duke, and Escalus, whose name reminds us of the scales of justice. In Angelo, we
see the strict application of law and the denial of the judicial role. The Duke illustrates the excess of mercy. The Duke also ends up denying law and betting for the theater instead. Shakespeare proposes that the solution is to be found in Escalus, who is able to balance the letter of the law and its spirit. While the law is respected, the different circumstances of the particular case are also considered. In this way, mercy is institutionalized into law through equity.
